Terms & Conditions Agreement
This Terms and Conditions Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Apex Servers ("Company", "we", or "us"), governing your access to and use of the Apex Servers platform, services, and related applications (collectively, the "App"). By accessing or using the App, you agree to be bound by this Agreement. If you do not agree to these terms, do not use the App.
1. Eligibility
You must be at least 13 years old to use the App. If you are under the age of 18, you may only use the App under the supervision of a parent or legal guardian.
2. User Conduct
You agree to use the App only for lawful purposes. You shall not:
Violate any applicable law or regulation;
Interfere with or disrupt the integrity or performance of the App;
Attempt to gain unauthorized access to the App or its related systems or networks;
Upload or distribute malicious code, spam, or other harmful content.
3. User Content
By uploading, posting, or submitting any content via the App, you grant Apex Servers a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, and display that content. You are solely responsible for the content you provide and agree not to submit anything that is unlawful, offensive, or infringes on others' rights.
4. Protection of Minors
We are committed to protecting the safety and privacy of minors. If you are a parent or guardian and believe your child is using the App inappropriately, please contact us immediately at support@apexservers.cloud.
5. Intellectual Property
All materials provided through the App—including but not limited to text, graphics, software, and logos—are the property of Apex Servers or its licensors, and are protected by intellectual property laws. You may not use our branding or materials without prior written permission.
6. Privacy
Your use of the App is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal information.
7. Termination
Apex Servers may suspend or terminate your access to the App at any time, with or without notice, and for any reason, including a breach of this Agreement.
8. Limitation of Liability
To the maximum extent permitted by law, Apex Servers shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profits, or other intangible losses arising out of or relating to your use of the App.
9. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Utah, without regard to its conflict of law principles.
10. Changes to This Agreement
We may revise this Agreement at any time. The updated version will be posted on the App, and your continued use of the App after any changes become effective constitutes your acceptance of the revised terms.
